What Is Military Diversion?
California law provides a pretrial diversion process for certain current and former members of the United States military who meet the statutory requirements.
Depending upon the individual circumstances, Military Diversion may provide an eligible servicemember or veteran with an opportunity to participate in appropriate treatment and services while the criminal case is diverted from the traditional prosecution process.
Military Diversion may involve certain conditions potentially related to military service, including post-traumatic stress disorder (PTSD), traumatic brain injury (TBI), substance abuse, mental health problems, or sexual trauma.
Eligibility is not automatic. Whether Military Diversion is available depends upon applicable California law, the charged offense, the individual's military service and circumstances, and the court's determination.
Military Diversion and DUI
Military Diversion may be available in certain misdemeanor DUI cases involving qualifying current or former members of the United States military.
A DUI charge does not necessarily mean that Military Diversion is unavailable. However, eligibility depends upon the particular facts and circumstances of the individual case.

Potential Benefits of Military Diversion
Military Diversion occurs before a traditional criminal conviction and generally requires the participant to comply with treatment and other conditions established by the court.
